Abstract

In Vietnam, issues related to gender reassignment surgery and gender identity have arisen during the implementation of the 1995 Civil Code. However, the Code did not have any provisions to regulate these issues. Therefore, in order to protect the legal rights and interests of individuals and adjust social relationships that arise in reality, the 2005 Civil Code for the first time stipulated that individuals have the right to determine their gender as a personal right. This right is currently recognized in the 2015 Civil Code, creating an important legal basis for specifying relevant provisions in specialized legal documents. Although there are still limitations, the provisions on the right to determine gender in the current period are a legal advancement, with a significant role and impact on the lives of millions of people with congenital gender disabilities in Vietnam.
